Acceptable Use Policy

The rules everyone in an Evrment workspace agrees to follow. Most of this is what a careful, licensed agent already does. It is written down so there is no ambiguity.

Purpose

This Acceptable Use Policy applies to every customer of EVRMENT (“Evrment”) and every User in a customer’s workspace. It is part of our Terms of Service. The account holder is responsible for making sure its Users follow it.

Evrment gives agencies powerful outreach tools. Used well, they help people get coverage they need. Used badly, they harm consumers, put agents’ licenses at risk, and can get phone numbers blocked for everyone. These rules exist to prevent that.

Outbound calling and messaging

Evrment provides tooling, not legal cover. Our do-not-call suppression, quiet-hours enforcement for automation, consent records, recording controls, and script linter help you run a careful program. They do not make your outreach lawful, and they do not replace your own compliance process or your own lawyer.

Consent

  • You are responsible for obtaining and keeping valid consent records for every person you call or text, in the form the law requires. Prior express written consent is generally required for marketing calls or texts using automated technology or prerecorded or artificial voices.
  • Do not upload or contact purchased, rented, scraped, or shared lists unless each record carries valid, documented consent that covers you and the type of outreach you plan.
  • Be able to produce a consent record for any consumer on request.

Do not call

  • You are responsible for your own do-not-call obligations, including the National Do Not Call Registry, applicable state do-not-call lists, and your own internal do-not-call list.
  • Honor opt-out requests promptly, by any reasonable method the consumer uses (“stop,” “remove me,” “don’t call me again”). Never argue with an opt-out or tell a consumer that no list exists.
  • Do not remove or work around do-not-call entries in Evrment in order to contact a suppressed number.

Laws you must follow

  • the Telephone Consumer Protection Act (TCPA) and FCC rules;
  • the Telemarketing Sales Rule;
  • state telemarketing laws and state “mini-TCPA” laws, including registration requirements and call frequency limits;
  • calling-hour rules, which in some states are stricter than federal law;
  • federal and state call recording laws, including two-party (all-party) consent states;
  • CAN-SPAM and state commercial email laws;
  • A2P 10DLC registration requirements and wireless carrier messaging rules.

Calling and messaging rules

  • Do not call or text outside lawful hours in the consumer’s local time zone.
  • Do not spoof caller ID or display a number you are not authorized to use.
  • Identify yourself and your agency clearly at the start of every call and in messages.
  • Do not record a call unless you have the consent the law requires. Recording is off by default in Evrment. If you turn it on, you are responsible for the disclosure.
  • Do not send text messages through unregistered brands or campaigns, or content that does not match your registered use case.
  • Do not use snowshoeing, number rotation, or other techniques designed to evade carrier filtering.

Prohibited claims and conduct

In any call, text, email, script, booking page, microsite, or other content, you must not:

  • misrepresent an affiliation with a government agency, the state, a lender, a mortgage servicer, or an insurance carrier, or imply that you were “assigned” to a consumer by any of them;
  • use false authority or fabricated urgency, such as saying a consumer’s file has been “flagged,” that the state requires them to answer questions, or that an offer expires when it does not;
  • claim guaranteed approval, guaranteed issue where it does not apply, or guaranteed rates before underwriting;
  • promise guaranteed returns, income, or investment performance;
  • describe indexed universal life (IUL) or any other product as “risk-free,” or as a substitute for an investment account without proper disclosure;
  • overstate the number of carriers you can place with, or your licenses, appointments, or credentials;
  • harass, threaten, or abuse anyone, or target people you know to be vulnerable in a way that exploits that vulnerability;
  • send content that is unlawful, deceptive, defamatory, hateful, or sexually explicit;
  • impersonate another agent, agency, or company.

Evrment’s script linter may warn when a script contains risky phrases. It never blocks, and a script without warnings is not approved or compliant by default. Your carrier or IMO may have its own review requirements.

Handling consumer data

  • Collect and store only the personal information you need to serve the consumer.
  • [DRAFT — counsel review required] Use the Evrment fields and workflows designated for sensitive insurance information to store only what your business genuinely requires. Sensitive identifiers (such as Social Security numbers), financial account information and detailed health information must never be entered into general-purpose notes, team messages, text messages, email or other unstructured fields unless that workflow is expressly designated and secured for that information. Designated protected fields are in development; until they are available in your workspace, no field is designated for that information.
  • Payment card numbers are never entered into Evrment. Card data stays with the payment provider.
  • [DRAFT — counsel review required] Evrment is not a HIPAA business associate unless separately agreed in writing. HIPAA-regulated workflow support is required before general availability; until it is available, do not rely on Evrment for HIPAA purposes.
  • Do not import data you do not have the right to use, or mix data belonging to another agency.

AI use rules

  • Review AI suggestions before acting on them or repeating them to a consumer. You are responsible for what you say.
  • Disclose the use of AI wherever the law or a carrier requires it, including for AI receptionists and, when available, AI voice.
  • Do not configure an AI feature to impersonate a specific real person, or to deny being an AI when sincerely asked.
  • Do not use AI features to generate the prohibited claims listed above.
  • Do not attempt to extract model prompts, bypass safety controls, or use AI features for purposes unrelated to your agency.

Security and platform rules

You must not:

  • share login credentials between people, or let anyone outside your agency use your account;
  • store carrier portal credentials in the vault that you are not authorized to use, or share revealed credentials in violation of the carrier’s terms;
  • upload malware, or probe, scan, or test the vulnerability of the service without our written permission;
  • scrape, crawl, or bulk-extract data from the service except through features or exports we provide;
  • reverse engineer, decompile, or try to access the source code of the service, except where the law expressly allows it;
  • interfere with the service, overload it, or get around usage limits, seat limits, or access controls;
  • resell, sublicense, or provide the service to third parties without a written agreement with us;
  • use the service to build a competing product.

Enforcement

We may investigate suspected violations. Depending on how serious the issue is, we may:

  1. warn you and ask you to fix the problem;
  2. remove or disable specific content, numbers, campaigns, or features;
  3. suspend calling, messaging, or your whole account;
  4. terminate your account under the Terms of Service.

For serious harm, such as spoofing, clear consent violations, or large volumes of complaints, we may act immediately without a warning. We cooperate with telephony and messaging carriers, which may take their own action against numbers and campaigns, and with law enforcement and regulators when legally required.

Reporting abuse

If you received unwanted calls or texts from an agency that uses Evrment, or you believe someone is misusing the service, email support@evrment.com. Include the phone number or email that contacted you, the date and time, and what happened. You can also reply STOP to any text message to opt out of that sender.
